The case law is difficult. It has been somewhat difficult for a time and it recently became much more so due to decisions of this court that are difficult to reconcile. The one that the plaintiff relies on is the decision of Mr. Justice Metzger in Amos v. Virk. The more recent decision relied on by the defendant is the decision of Mr. Justice Scarth in Ludsiak v.
