In what circumstances will a husband be liable for the maintenance of his wife?

Saskatchewan, Canada

The following excerpt is from Fisher v. Fisher, 1980 CanLII 2108 (SK CA):

And again in Keeler v. Keeler (1978), 1977 CanLII 2621 (SK CA), 4 R.F.L. 193, Culliton, C.J.S., said: In determining a fair and equitable distribution of the marital property, sight should not be lost of the fact that the husband is liable for maintenance of the wife - a liability which is a constant one and which may be varied from time to time.

The greater contribution by the husband was considered by this court in Birkeland v. Birkeland (1979), 1979 CanLII 3446 (SK CA), 10 R.F.L. 42, and the amount awarded by the trial judge, approximately one-third of the total joint assets, was upheld.
