This is hard-fought, bitter litigation. There has already been much procedural wrangling. Among other things, the defendant has already applied for an order that the court decline jurisdiction in respect of the false imprisonment claim on the basis that China is a more appropriate forum. Madam Justice Ross dismissed that application with reasons indexed as Huang v. Silvercorp Metals Inc., 2015 BCSC 549. I am advised that her decision is under appeal.
