The leading authority setting out the matters to be considered by the court in a case such as this is Gordon v. Goertz, 1996 CanLII 191 (SCC), [1996] 2 S.C.R. 27. The threshold question is whether the proposed move constitutes a "material change" to the "condition, means, needs or other circumstances of the child". Here the mother concedes her proposed move amounts to a material change.
