The following excerpt is from Seneka v. LeDuc, 1985 CanLII 1465 (AB QB):
In Garfield v. City of Toronto, 22 O.A.R. 128, it was held that where a sewer built and maintained by a municipal corporation is free from structural defect and is of sufficient capacity to answer all ordinary needs (as is the case at bar), the corporation is not liable for damages caused as a result of an extraordinary rainfall.
