The circumstances of this case are different from R v. Mathieu and R v. Kosmak. It include factors which overall are of a more aggravating nature: 1) The most significant factor is the serious nature of the injuries suffered by the two (2) victims. One victim lost an eye and suffered a brain injury which will result in him being unable to work and very likely dependent for life. The other victim had his jaw broken and also suffered other injuries; 2) The attack was deliberate and planned; 3) A weapon was used and the degree of injury was foreseeable 4) The attack took place at the home of one of the victims who was injured while essentially acting as a good Samaritan, 5) No explanation was offered for the attack by the two accused who expressed limited remorse.
