Each case of course stands on its own facts. I find most helpful, however, the discussion by Slatter, J. in Gordon v. Bourque, particularly as it relates to the factors to consider in awarding costs in a case of a challenge to election results. Normal costs rules apply and costs would ordinarily be granted in column 1 of Schedule C. The Settlement concedes that at least column 3 is appropriate given the complexity of the matter. They take issue however with some of the items claimed on the Bill of Costs. I will deal with those once I determine the appropriate column and multiple if appropriate. I will review the factors set forth by Slatter, J. as they apply to this case. Result
