This appeal is technically moot; however, as the litigation is proceeding, all parties took the position that the appeal should be heard because the issue will be raised again during the course of the trial. In my view, it is in the interests of judicial economy to decide the appeal in these circumstances (see Borowski v. Canada (Attorney General), 1989 CanLII 123 (SCC), [1989] 1 S.C.R. 342).
