In Prior v. Moore, 3 T. L.R. 624, it was held that an agent appointed to sell land has, in the absence of express instructions, no authority to sign a contract for sale on behalf of his principal. In Chadburn v. Moore, 61 L. J. Ch. 674, Kekewich, J., said that, Unless express authority is given to the agent to sell, and for that purpose to enter into a binding contract, the principal reserves his final right to accept or refuse.
