Although the Accused has been in custody since the middle of March 2013 and his preliminary date is not until January of 2014, if convicted of a major sexual assault, which these allegations constitute under R v. Arcand, [2010] ABCA 363 the Accused would be facing a significant period of incarceration. However the Accused is presumed to be innocent until proven guilty beyond a reasonable doubt, and it appears that he is prepared to provide a full answer in defence on the charge that he is facing.
