Overwaitea argued that since there was a significant gap between the allegations leading up to the spring of 2003, the allegations that give rise to the accommodation grievance and the most recent allegations and, that such gaps undermine the continuing nature of the allegations: Low v. Registered Nurses’ Association of B.C. and Jacinta MacKinnon, 2004 BCHRT 70 at para. 15. Although there may be gaps, this does not override the fact that the allegations, seen as a whole, and if proven, may reflect a continuing pattern of discrimination in the workplace.
