What is the quantum of damages for a plaintiff who sustained a fractured skull in a motor vehicle accident?

Damages under this head is an assessment. Awards made in other cases involving similar circumstances and injuries provide guidance but each case requires an assessment on its own unique circumstances. Assessments under this head are guided by many factors and a non-exhaustive list of considerations is listed in Stapley v. Hejslet, 2006 BCCA 34: age of the plaintiff; nature of the injury; severity and duration of pain; disability; emotional suffering; impairment of life; impairment of family, marital and social relationships; impairment of physical and mental abilities; loss of lifestyle; and the plaintiff's stoicism (which should generally not detract from the award).
