In Aspe v. Aspe, 2010 BCCA 508, the court considered retroactive spousal support and concluded that similar factors to those established for child support in D.B.S. may be applied in considering whether a variation of spousal support should be retroactive: para. 56-57. The court described the factors as “the needs of the recipient, the conduct of the payor, the reason for the delay in seeking the order, and any hardship a retroactive award may cause the payor spouse”: at para. 56.
