The factors to be considered in a claim for retroactive spousal support are similar to those to be considered for retroactive child support: Kerr v. Baranow, 2009 BCCA 111 at ¶87. The factors include, but are not limited to, the needs of the recipient, the conduct of the payor, the reason for the delay in seeking support, and any hardship the retroactive award may occasion on the payor spouse: D.B.S. v. S.R.G., 2006 SCC 37 at ¶76.
