Although the word “retaliation” does not appear in this section, the term is frequently used as a short hand to describe the conduct that the section prohibits: Gichuru v. Law Society of BC, 2010 BCCA 543 at paras. 40‐41. Protection from retaliation is fundamental to giving life to the Code by promoting access to justice and ensuring that people needing recourse thereunder are properly free to pursue it.
