The worker has submitted a newspaper article regarding Powell v. ICBC, 2016 BCSC 1432. The court determined the plaintiff in that case was entitled to temporary disability benefits even though she was not receiving them on the two-year anniversary of the motor vehicle accident. That 2016 court decision does not contain substantial and material evidence as to whether special circumstances precluded the worker from applying for compensation within one year of his August 24, 2009 injury.
