Penalty decisions in Law Society discipline hearings have recently been guided by a series of considerations that were first described by a panel in Law Society of BC v. Ogilvie, [1999] LSBC 17. In that decision, a panel set out a series of considerations as guidelines to assist subsequent panels in considering what penalties are appropriate for professional misconduct. We will detail the considerations outlined in Ogilvie and comment on their impact on our decision in this case. The “Ogilvie” headings are shown in italics.
