The hearing panel then considered the factors set out in Law Society of BC v. Ogilvie, 1999 LSBC 17, for assessing the penalty to be imposed. The hearing panel observed that not all of these factors are necessarily relevant in every case. It also acknowledged that, in Lessing at para. 57, two factors were identified as particularly important in determining the appropriate disciplinary action: maintaining public confidence in the profession and the rehabilitation of the lawyer.
