This was the factual matrix in which the legal issue of whether the term “parking” included storage of vehicles. Dorgan J., following McKinnon J., concluded that it did not. Deference must be accorded to that interpretation of clause 4.01(a) in the absence of a palpable and overriding error, or a conclusion that was clearly wrong or was not reasonably supported by the evidence: Housen v. Nikolaisen, 2002 SCC 33 at paras. 8-12. None have been demonstrated. However, I also agree that in this context “parking” does not include “storage”.
