In Gordon v. Goertz (1996), 1996 CanLII 191 (SCC), 19 R.F.L. (4th) 177 (S.C.C.) McLauchlin J. speaking for the majority of the court states at p. 192 that parental conduct does not enter into the analysis of who is the better parent to look after the child unless the conduct relates to the ability of the parent to meet the needs of the child.
