The amendment to Rule 13 in 2002 incorporated the “no arguable issue” standard. There is no meaningful difference between an “arguable” issue and a “genuine” or “bona fide” issue: see United Gulf Developments Limited v. Iskandar 2004 NSCA 35 at paras. 6-9.
