In Nicholson, supra, in determining the scope of rule 8, supra, the court relied upon Gurtner v. Circuit et al., supra, that a person may be added as a party where the determination of an action could directly affect him. The application was allowed on the ground that the applicant, as the insurer, was interested in the outcome of the action, because it could be liable to pay the amount of any judgment awarded to the plaintiff.
