In Fonseca v. Jones, one defendant admitted the allegations in the statement of claim and submitted to the relief claimed, and another defendant denied the plaintiff’s rights. Yet the learned Judge held that the defendants were not adverse in point of interest as there were no rights to be adjusted between them.
