In R v. Nguyen 2001 BCCA 461, the offender had pleaded guilty to production. She had no criminal record. Police executing a search warrant had found 106 plants. The trial judge imposed a custodial sentence of one year, to be followed by probation for one year. The appeal was allowed and a conditional sentence of one year substituted.
