Master Funduk’s perspective has been recently reinforced in Bahcheli v. Yorkton Securites Inc. (2012 ABCA 166) which in effect concludes that Master’s decisions regardless of their character are to be given no deference by the superior courts. Indeed to do so it would seem would be an error of law subject to review on a standard of correctness. Regardless, I am tasked with reaching the correct decision and will endeavor to do so.
