Does a plaintiff have a right to sue for overtime in court?

Manitoba, Canada

The following excerpt is from Hutlet v 4093887 Canada Ltd. et al, 2012 MBQB 342 (CanLII):

The plaintiff submits that application of the principles set out in these cases establishes the employee’s right to sue for overtime in court. While the Macaraeg v. E Care Contract Centers Ltd. [supra] decision refers to the cases cited above and comes to an opposite conclusion, the plaintiff argues that the Macareag decision considered in light of the previous cases appears to be an anomaly.
