Liability attaches to anyone who either creates or causes a nuisance. It also attaches to a person, such as a landowner, who expressly authorizes the nuisance or where the nuisance is certain to result from the purposes for which the property is used: Smith v. Scott, [1972] 3 All E.R. 645.
