Saskatchewan, Canada

The following excerpt is from Barish & Co. v. Rural Municipality of the Gap No. 39, 1925 CanLII 94 (SK CA):

In Leigh v. Dickeson (1884) 15 Q.B.D. 60, 54 L.J.Q.B. 18, at p. 20, Brett, M.R., says: It has, however, always been equally clear law that a plaintiff cannot compel repayment from a defendant of money which he has paid voluntarily, upon the ground that it was expended for the benefit of the defendant and that the defendant has reaped the benefit of such expenditure.
