Although the parties have filed conflicting expert reports, as stated by my brother, Butler J., in Chalmers v. AMO Canada Company, 2009 BCSC 689 at para. 17, aff’d 2010 BCCA 560, at this stage of these proceedings I do not need to resolve conflicting expert opinions because this is not a determination of the merits.
