29 Powell v. Texas (1989) 492 U.S. 680, 109 S.Ct. 3146, 106 L.Ed.2d 551 is distinguishable. The defendant in that case was ordered by the trial court at the state's request to undergo a psychiatric examination by an appointed psychiatrist. Neither the accused nor his attorney was informed about the scope of the examination and the accused was not informed that, since the examination was required by the state, he had the right to remain silent.
