Merkle, 137 F3d 1172, 1176 (1998); see also, Cullen v. Pinholster, _U.S._, 131 S.Ct. 1388 (2011 ( a 2254(d) issue must be decide on the state record). A review of the plea proceedings demonstrates that petitioner's plea was voluntarily and intelligent and he was not suffering from any confusion, stress or other mental problems. If nothing else, the record shows that petitioner was extremely eager to plea quickly as soon as possible in order to be released. Doc. 21, at 90108.
