The following excerpt is from People v. Humphrey, C052744, Super. Ct. No. 02F02888 (Cal. App. 2011):
Defendant approached the five men on the porch. The men were playing poker with a coin dish with money in it on the table. Defendant asked to play, but when rebuffed he told the men to give him the money. Defendant drew a gun and struggled with several of the poker players. Under these circumstances, each man at the table was a victim of the attempted robbery. Where a defendant robs one person, and in the commission of the robbery kills a different person, the defendant may be punished for both robbery and murder. (People v.
