This same point was made by Mr. Justice Gibson in Melinte v. Canada (M.C.I.)8. This was a judicial review of an immigration officer"s decision that the applicant did not meet the eligibility criteria for the deferred removal orders class ("DROC") because he did not apply within 120 days of becoming eligible. Gibson J. said the following at page 294 of his decision:
