The following excerpt is from R. v. Leis, 2021 ONCJ 86 (CanLII):
56. In R v. Stewart,[xv] the offender pled guilty and received a thirty -month sentence for impaired driving causing bodily harm. The offender had a blood alcohol concentration of between 145-200mgs when he lost control of his vehicle while driving at an excessive speed. The ensuing accident resulted in one of the passengers having his spleen removed while the other was rendered a paraplegic. The offender had a prior record for impaired driving approximately 7 years prior.
57. In R v. Mitchell[xvi], the offender pled guilty to two counts of impaired driving causing bodily harm. She had a blood alcohol concentration of between 102-117 mgs when she lost control of her vehicle which crashed into a tree and a building. She was 31 years of age and had no prior criminal record. The two passengers in the vehicle had extensive injuries which required surgery and the likelihood of ongoing medical assistance in the future.
