We fail to see how this argument relates to CALCRIM No. 440. Its purpose was to instruct the jury as to the law. (People v. Saldana (1984) 157 Cal.App.3d 443, 453.) A jury instruction is not designed to give a defendant "adequate notice of what constitutes a felony" vis--vis the prosecutor's charges.
