In Gichuru v. Palmar Properties Inc., 2011 BCSC 827, Mr. Justice Pearlman also found that a dispute resolution officer had not conducted a fair hearing. In that case, written submissions had been accepted by the Branch after the hearing, and the opposing party had not had an opportunity to receive those and to respond to them. Pearlman J. stated:
