The following excerpt is from Rocky Mountain Farmers Union v. Goldstene, C/w member case: 1:10-cv-163-LJO-BAM, Lead case: 1:09-cv-2234-LJO-BAM (E.D. Cal. 2014):
12. The law of the case doctrine has three exceptions that may permit departure from the law of the case when: (1) the original decision is clearly erroneous and its enforcement would work a manifest injustice, (2) intervening controlling authority makes reconsideration appropriate, or (3) substantially different evidence was adduced at a subsequent trial. Old Person v. Brown, 312 F.3d 1036, 1039 (9th Cir. 2002). No party suggests that any of these exceptions applies here.
