3 Hubbard found that the fireman's rule precludes liability for reckless as well as negligent conduct that requires the summoning of a firefighter or police officer. The court reasoned that the principles and policy considerations underlying the fireman's rule are equally applicable whether the defendant's conduct is reckless or negligent.
