The following excerpt is from People v. Zavala, H036028 (Cal. App. 2013):
"The purpose of trial by jury . . . is to prevent government oppression by providing a 'safeguard against the corrupt or overzealous prosecutor and against the compliant, biased, or eccentric judge.' [Citation.]" (Burch v. Louisiana (1979) 441 U.S. 130, 135 [99 S.Ct. 1623].) Defendant Rodriguez has not cited any authority establishing that admission of an expert opinion without disclosing to the jury its entire testimonial hearsay basis, including the declarants, implicates the constitutional right to jury trial.
