The following excerpt is from People v. Dees, 221 Cal.App.3d 588, 270 Cal.Rptr. 554 (Cal. App. 1990):
1 The People also refer us to United States v. Rickus (E.D.Penn.1972) 351 F.Supp. 1379, 1383, wherein the district court determined that the defendant's disclaimer at the motion to suppress negated any recognizable interest of privacy in the contents of the car. But again, there was no evidence that defendant ever asserted any interest in the car, at the time of the search or otherwise. The police apparently searched the car, unbeknownst to defendant and outside his presence, after his arrest.
