The defendant’s counsel did not strongly press that this was not a case where relief should be given against forfeiture if the court had power to give such relief, which he contended it did not have on the authority of the decision in Ramsay v. Hildred 1930 CanLII 104 (SK CA), [1930] 2 WWR 692, 25 Sask LR 1, a case in which judgment was given by our own court of appeal on June 26, 1930.
