CSIC claims that Salway v. Amix Salvage and Sales, 2011 BCHRT 31 makes the following point: if a business that would otherwise be a local undertaking has inter-provincial or extra-provincial services that are a continuous and regular part of the operation, then the business is under federal jurisdiction. If one has a trucking business that operates solely in the Lower Mainland, then the business is going to be subject to provincial jurisdiction. If one has a business that routinely sends trucks across the US border, and across the Alberta border, then the business is going to be under the federal sphere.
