In Canadian Encyclopaedic Digest (Western), volume 6, at page 72 paragraph 9 the text states: A court has jurisdiction in personam only if the defendant is duly served with the originating process or voluntarily submits to the jurisdiction. The authority mentioned Merchants Bank v. Eliot, [1918] 1 W.W.R. 698.
