In R v. VanEindhoven 2013 NUCJ 30 the accused stabbed his common law spouse in the heart after a severe assault and while he was under a court order to have no contact with her. He had been emotionally and physically abusive towards her when drinking and had punched and bit her the night before the murder. She had tried to end the relationship on many occasions but she always came back. The court set his parole ineligibility at 13 years.
