As I noted in Brar No. 11, there have been gaps in the hearing dates for a variety of reasons. Further, previous gaps do not necessarily lead to the conclusion that yet another gap is not significantly prejudicial to the Complainants. As noted in C.S.W.U. Local 1611 v. SELI Canada and others (No. 4), 2007 BCHRT 442, there is an inherent prejudicial effect when a complaint is adjourned in the midst of a hearing and this is true in the circumstances of this proceeding.
