I do not agree with the plaintiffs submission that Bechthold v. Wendell Motor Sales Ltd. (2007), 162 A.C.W.S. (3d) 585, [2007] O.J. No. 4886, stands for the proposition that waiver of solicitor client privilege must be pleaded.
