More recently, chambers judges have refined this proposition, pointing out that the most significant factor in assessing applications to extend time is the interests of justice, and stating that an extension of time could be refused if the lack of merit renders the continuation of the appeal contrary to the interests of justice: see Baldwin v. Baldwin, 2012 BCCA 116; Lit v. Lit, 2019 BCCA 158.
