To succeed on an application for leave to appeal a costs award, strong grounds on which this court could find that the trial judge erred in exercising their discretion must be shown: Hobbs v. Hobbs, 2008 ONCA 598, 54 R.F.L. (6th) 1, at para. 32. A court should only set aside a costs award on appeal if the trial judge has made an error in principle or if the costs award is plainly wrong: Hamilton v. Open Window Bakery Ltd., 2004 SCC 9, [2004] 1 S.C.R. 303, at para. 27.
