Aggravated damages for mental distress arising from the breach of contract, or lack of reasonable notice, are compensable damages that may be awarded in certain circumstances: Vorvis v. Insurance Corporation of British Columbia, [1989] l S.C.R. 1085. They may arise when the conduct of the employer, at the time of the breach, is of a wanton or reckless character, thereby aggravating the existing damages which arise from the wrongful dismissal. They are not awarded merely for "injured feelings" or emotional distress that may occur from the dismissal itself.
