In relation to addiction, generally it is a factor that courts can take into account in arriving at a fit sentence for an offender. That is as long as there is a nexus between the addiction and the offence. The presence of the addiction impacts the moral blameworthiness of the offender and can be a mitigating factor. (R v. Horvath 1997 CanLII 9759 (SK CA), 117 CCC (3d) 110, R v. Branton, [2013] NJ. No. 408).
